Fraud​

Fraud occurs when a person obtains property from someone else through a dishonest act of deception. It is important to understand that fraud is only committed if the deception is intentional.

-What must the police prove?

Yes, it may be possible to avoid a criminal conviction ifTo successfully prosecute a charge of fraud, the police must prove each of the following elements beyond reasonable doubt:
1. The accused;
2. By any deception- Deception means any  deception , by words or other conduct, as to fact or as to law, including a  deception  as to the intentions of the  person  using the  deception  or any other  person , or conduct by a  person  that causes a computer, a machine or any electronic device to make a response that the  person  is not authorised to  cause  it to make.
3. Dishonestly- Means  dishonest  according to the standards of ordinary people and known by the defendant to be  dishonest  according to the standards of ordinary people.
4. obtained property or – Property is considered ‘obtained’ when a person takes control or possession of it, or assumes ownership of it for themselves.
5. financial advantage; or
6. caused a financial disadvantage the court decides to impose a Conditional Release Order (CRO), previously known as section 10.

Penalties for Fraud

Penalties for Fraud range from not recording a conviction to a sentence of full-time imprisonment. The court will consider the following factors in determining the ultimate penalty:
1. The level of sophistication of the fraud.
2. The value of the amount subject to the charge
3. Whether the fraud was part of organised criminal activity.
4. Whether the offender has a prior record
5. Whether the offender has mental health issues
6. Whether the offender has shown remorse for their actions

-Will I get a criminal record for Fraud?

It is possible that a criminal conviction will be recorded. Fraud is a serious offence and the courts treat it as such through the penalties imposed on offenders.
