Client found not guilty of criminal charges after a court finds that the police acted outside their powers. Costs awarded to the client.
Our 30 year old client was charged with a number of drug, and proceeds of crime related charges. The allegations arose out of a search of our client’s vehicle, which located an amount of drugs, a large sum of money, and a number of different mobile phones.
Our principal solicitor Talal Krayem closely scrutinised the Brief of Evidence in relation to this matter and identified a potential gap in the police case.
It was argued by our team that the police, who stopped our client for a traffic infringement, did not have any reasonable grounds to conduct a search of his vehicle.
On the Hearing day, the matter was head by a Magistrate of the Local Court who agreed with Mr. Krayem’s submissions. The Magistrate held that the Police did not have a legal basis to conduct the search and excluded the evidence arising from the search.
The prosecution then had to withdraw the charges and the court allowed our client to recover his legal costs from the NSW Police.
