Our client was a 29-year-old man from Blacktown who works as a warehouse logistics coordinator. He had been living in Australia on a partner visa and was building a stable life with his partner when an argument at home escalated, resulting in police involvement.
Following the incident, police charged him with two counts of Domestic Violence – Assault Occasioning Actual Bodily Harm relating to allegations made by his partner. Concerned about the seriousness of the charges and the potential impact on his immigration status and future, he contacted Krayem & Co for urgent legal assistance.
The matter was handled by lawyer Mohammad Wafai, who immediately began preparing the defence case. Mohammad carefully reviewed the allegations and commenced gathering key evidence, including witness statements and supporting materials, to challenge the claims made against our client.
In the weeks leading up to the hearing, Mohammad Wafai and the client worked closely together to ensure the defence case was thoroughly prepared. The matter eventually proceeded to a hearing at the Parramatta Local Court, where the Magistrate asked the defence to outline the nature of the case.
Mohammad clearly presented the defence position during his opening submissions. After hearing the outline of the defence case, Her Honour directed the prosecutor to confer with the defence before proceeding further with the hearing, with the aim of saving court time and avoiding unnecessary distress to witnesses.
Detailed negotiations then took place between the prosecution and the defence. During these discussions, Mohammad Wafai strongly advocated for the charges to be withdrawn, highlighting the weaknesses in the prosecution case and the compelling evidence gathered by the defence.
As a result of the thorough preparation and strategic negotiations conducted by Krayem & Co Lawyers, the prosecutor ultimately agreed to withdraw all charges before the hearing proceeded.
The Magistrate formally dismissed the charges in court, allowing our client to walk away without a criminal conviction and without facing the risk of imprisonment. The outcome also ensured that his visa status and future in Australia were protected.
