Supreme Court Grants Bail Following Critique of Prosecution Evidence

The NSW Supreme Court has granted bail to Noah Touma after a judge raised significant questions regarding the strength of the prosecution’s case.   • Identification Concerns: Consequently, Justice Harrison stated it would be difficult for a jury to be satisfied of the shooter’s identity beyond a reasonable doubt.

The Bail Ruling

Because a potential trial may not proceed until 2026, the court considered the nine months the client has already spent in custody. Justice Harrison granted bail under strict conditions to ensure community safety and compliance:

  • Rehabilitation: The client must attend a live-in drug treatment facility.

  • Travel Restrictions: He has surrendered his passport to the authorities.

  • Communication: He is restricted to possessing only one mobile phone.
