Our <\/span>client <\/span>was <\/span>a <\/span>29-<\/span>year-<\/span>old <\/span>man <\/span>from <\/span>Blacktown<\/span><\/strong> who <\/span>works <\/span>as <\/span>a <\/span>warehouse <\/span>logistics <\/span>coordinator. <\/span>He <\/span>had <\/span>been <\/span>living <\/span>in <\/span>Australia <\/span>on <\/span>a <\/span>partner <\/span>visa <\/span>and <\/span>was <\/span>building <\/span>a <\/span>stable <\/span>life <\/span>with <\/span>his <\/span>partner <\/span>when <\/span>an <\/span>argument <\/span>at <\/span>home <\/span>escalated, <\/span>resulting <\/span>in <\/span>police <\/span>involvement.<\/span><\/p>\n

Following <\/span>the <\/span>incident, <\/span>police <\/span>charged <\/span>him <\/span>with <\/span>two <\/span>counts <\/span>of <\/span>Domestic <\/span>Violence \u2013 <\/span>Assault <\/span>Occasioning <\/span>Actual <\/span>Bodily <\/span>Harm<\/span><\/strong> relating <\/span>to <\/span>allegations <\/span>made <\/span>by <\/span>his <\/span>partner. <\/span>Concerned <\/span>about <\/span>the <\/span>seriousness <\/span>of <\/span>the <\/span>charges <\/span>and <\/span>the <\/span>potential <\/span>impact <\/span>on <\/span>his <\/span>immigration <\/span>status <\/span>and <\/span>future, <\/span>he <\/span>contacted <\/span>Krayem & <\/span>Co<\/span><\/strong> for <\/span>urgent <\/span>legal <\/span>assistance.<\/span><\/p>\n

Mohammad <\/span>clearly <\/span>presented <\/span>the <\/span>defence <\/span>position <\/span>during <\/span>his <\/span>opening <\/span>submissions. <\/span>After <\/span>hearing <\/span>the <\/span>outline <\/span>of <\/span>the <\/span>defence <\/span>case, <\/span>Her <\/span>Honour <\/span>directed <\/span>the <\/span>prosecutor <\/span>to <\/span>confer <\/span>with <\/span>the <\/span>defence <\/span>before <\/span>proceeding <\/span>further <\/span>with <\/span>the <\/span>hearing, <\/span>with <\/span>the <\/span>aim <\/span>of <\/span>saving <\/span>court <\/span>time <\/span>and <\/span>avoiding <\/span>unnecessary <\/span>distress <\/span>to <\/span>witnesses.<\/span><\/p>\n

Detailed <\/span>negotiations <\/span>then <\/span>took <\/span>place <\/span>between <\/span>the <\/span>prosecution <\/span>and <\/span>the <\/span>defence. <\/span>During <\/span>these <\/span>discussions, <\/span>Mohammad <\/span>Wafai <\/span>strongly <\/span>advocated <\/span>for <\/span>the <\/span>charges <\/span>to <\/span>be <\/span>withdrawn<\/span><\/strong>, <\/span>highlighting <\/span>the <\/span>weaknesses <\/span>in <\/span>the <\/span>prosecution <\/span>case <\/span>and <\/span>the <\/span>compelling <\/span>evidence <\/span>gathered <\/span>by <\/span>the <\/span>defence.<\/span><\/p>\n
