However,<br \/>incompetence or carelessness by your legal representative can be grounds<br \/>of an appeal where it has caused a miscarriage of justice.<\/li><\/ul><\/li><li><strong>Error in exercising discretion to allow or exclude evidence in a trial.<\/strong><ul><li>Where the original court made a mistake as to the facts, failed to consider<br \/>relevant information, took into account irrelevant considerations, or acted<br \/>on an incorrect principle of law.<\/li><\/ul><\/li><li><strong>Fresh evidence.<\/strong><ol><li>Where the CCA concludes that a miscarriage of justice resulted from the<br \/>absence of the fresh evidence at the District Court trial.<\/li><li>A conviction may be quashed if the fresh evidence is credible, was<br \/>unavailable at trial despite reasonable diligence, and could have caused<br \/>the jury to entertain reasonable doubt.<\/li><\/ol><\/li><li><strong>The convictions are unreasonable and\/or not supported by the evidence.<\/strong><ol><li>Where the CCA determines it was not open to the jury to be satisfied beyond<br \/>reasonable doubt that the accused was guilty.<\/li><\/ol><\/li><li><strong>Inconsistent verdicts.<\/strong><ol><li>Where guilty verdicts are inconsistent with other verdicts to the extent<br \/>that they offend logic and common sense.<\/li><\/ol><\/li><li><strong>Misdirection in the summing up by the Judge to the Jury.<\/strong><\/li><li><strong>Procedural unfairness.<\/strong><\/li><\/ol><h5>Grounds for a severity appeal (appealing the severity of a sentence) include:<\/h5><ol><li><strong>The original sentence was \u201cmanifestly excessive\u201d.<\/strong><ul><li>Where no specific error is identified, but the sentence is so excessive<br \/>compared to others that an error must be inferred.<\/li><\/ul><\/li><li><strong>A specific error<\/strong> was made by the sentencing Judge:<br \/><ol type=\"a\"><li>Failure to take material considerations into account.<\/li><li>Factual mistakes material to the sentence, including:<ul><li>No evidence to support findings of fact<\/li><li>Evidence was all one way<\/li><li>Misdirection by the Judge<\/li><li>An error of fact affecting the sentence<\/li><\/ul><\/li><li>Taking irrelevant matters into account.<\/li><li>Applying incorrect principles of law.<\/li><\/ol><\/li><li><strong>Fresh evidence.<\/strong><ul><li>The CCA may allow the appeal where the fresh evidence:<ul><li>Would have had a real bearing on the sentence<\/li><li>Was unknown or its significance was not realised by the offender<\/li><li>Was not known to the offender\u2019s lawyer(s) at the time<\/li><\/ul><\/li><\/ul><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t<details id=\"e-n-accordion-item-2151\" class=\"e-n-accordion-item\" >\n\t\t\t\t<summary class=\"e-n-accordion-item-title\" data-accordion-index=\"2\" tabindex=\"-1\" aria-expanded=\"false\" aria-controls=\"e-n-accordion-item-2151\" >\n\t\t\t\t\t<span class='e-n-accordion-item-title-header'><div class=\"e-n-accordion-item-title-text\">  What is the time limit and process to appeal to the CCA?
