Bail Granted for Passenger Following Mid-Air Incident

Defense team successfully argues that mid-air incident was an isolated conflict, not a hate crime or community threat.

In a matter heard at a Sydney bail court on Thursday, the legal team for Nazih Chahine, 19, successfully secured his release on conditional bail. Mr. Chahine had been taken into custody by Australian Federal Police following an alleged incident on a return flight from Bali.

The Arguments for Bail

Represented by barrister Ertunc Ozen and solicitor Talal Krayem, the defense emphasized that the allegations, while significant, did not reflect a broader threat to the community or extremist ideologies.

The defense highlighted several key points during the application:

  • Disavowal of Extremism: Counsel noted that the client and his associates explicitly disavowed any sympathy for recent tragic events in Bondi.

  • Context of the Conflict: The defense argued that the incident was a “moment of conflict” arising from an earlier disagreement regarding airline regulations, rather than a targeted hate crime.

  • Lack of Prior History: It was noted that there was no evidence of the client holding extremist beliefs or having prior involvement with counter-terrorism authorities.

Defense Clarifications

During the proceedings, Mr. Ozen clarified the defense’s position on the alleged statements. He described the situation as a young man making a “foolish” or “distasteful” remark at an unfortunate time, rather than a premeditated threat. Furthermore, the client denied making the hand gesture or direct threats as alleged by the police.

Conditions of Release

Magistrate Daniel Covington granted bail, noting that Commonwealth prosecutors did not oppose the application. To ensure community safety and legal compliance, the court imposed several conditions:

  • Residency: The client must reside at a designated address in Western Sydney.

  • Exclusion Zones: He is prohibited from entering the suburbs of Bondi or Bondi Beach.

The matter is scheduled to return to court in February. The legal team at Krayem & Co continues to work diligently to ensure a fair and thorough defense as the judicial process proceeds.
